Refund and cancellation policy

Last updated

This Refund and Cancellation Policy governs the treatment of Charges paid for the Service. All provisions concerning discretionary refunds are subject to the express reservation of mandatory statutory rights in clause 6.

1. Interpretation and application

1.1 “JP Clips” means the operator trading as JP Clips; “Service” means the JP Clips website, Discord bot and associated digital functionality; “Purchaser” means the person purchasing an entitlement; “Support” means the authorised support representatives of JP Clips; “Charges” means amounts paid for the relevant entitlement.

1.2 This Policy applies to all Charges, including monthly subscriptions, yearly subscriptions, lifetime plans, renewal payments and cryptocurrency payments. It forms part of the Terms of Service and shall be construed subject to mandatory consumer law.

2. Charges and entitlement

2.1 Premium confers the features specified in the applicable offer, including website access, custom watermarks, queue priority and unlimited renders under the global allowance, subject to partner-specific limits. Advertised Charges are:

2.2 JP Clips is not VAT registered; these prices have no VAT added. The applicable total shall be disclosed before purchase. Stripe processes card payments; NOWPayments processes cryptocurrency payments. The free 14-day Discord Trial is not a paid subscription and does not include website access.

3. Exclusive discretion in respect of refunds

3.1 Except to the extent that a refund or other remedy is required by applicable law, ALL refunds are at the sole discretion of JP Clips Support. No Purchaser shall have an automatic contractual entitlement to a full, partial or pro-rata refund, irrespective of the plan, duration, payment method or renewal status of the purchase.

3.2 Without limiting clause 3.1, non-use of the Service, unused entitlement, change of mind, accidental purchase, dissatisfaction or failure to cancel a renewal shall not, of themselves, establish entitlement to repayment. This provision is expressly subject to clause 6.

3.3 Support may approve or refuse a voluntary refund after considering the circumstances, including purchase date, use of the Service, the nature of any alleged defect, supporting evidence and previous refunds. The amount and conditions of an approved voluntary refund shall also be determined by Support.

3.4 Neither submission nor acknowledgement of a request shall constitute acceptance, approval or an undertaking to refund. A refund granted in one instance shall not create a precedent, waiver or entitlement in any subsequent instance.

4. Submission and determination of requests

4.1 Requests shall be directed to [email protected] and should identify, where available, the Purchaser’s Discord identifier, order or invoice reference, payment date, plan, payment method, grounds of request and remedy sought.

4.2 Support may require proportionate proof of purchase or authority before determining a request. Full card numbers, security codes, passwords, access codes, wallet private keys and recovery phrases shall not be submitted. Acknowledgement shall not be construed as approval. Statutory response periods shall prevail over any discretionary assessment process.

5. Cancellation of recurring subscriptions

5.1 Monthly and yearly card subscriptions shall renew until effectively cancelled. Cancellation may be submitted through the Cancel subscription button at buy.jpclips.tv; Manage Subscription in Premium Settings links to that portal. Cancelling stops future renewals and does not, of itself, reverse a Charge already incurred.

5.2 Cryptocurrency purchases confer a direct entitlement and are not Stripe subscriptions. Lifetime purchases are one-off transactions without recurring renewal. Cancellation of a render or restoration of a render allowance shall not constitute repayment of a Charge.

6. Reservation of mandatory statutory rights

6.1 Your statutory rights are not affected. Nothing in this policy makes a refund discretionary where applicable law requires it. This Policy shall not exclude or restrict a remedy available under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or other mandatory law.

6.2 A UK consumer may have a 14-day right to cancel a distance contract, subject to statutory conditions and exceptions. Where a service is supplied during that period at the consumer’s express request, a proportionate charge may be payable only where the statutory requirements are satisfied.

6.3 Loss of cancellation rights upon full performance of a service, or commencement of digital-content supply, requires the applicable express consent and acknowledgement. Agreement to this Policy shall not, by itself, establish that such consent or acknowledgement has been obtained.

6.4 Where applicable standards of description, quality, fitness for purpose or reasonable care and skill are not met, the Purchaser may be entitled to repeat performance, repair, replacement, a price reduction or refund, as applicable to the supply and circumstances. Mandatory protections in the consumer’s country of residence shall remain unaffected.

7. Settlement of approved or mandatory refunds

7.1 Where a refund is approved or required by law, Support shall confirm the amount and arrange an appropriate payment route, normally the original method where available. Receipt may be subject to payment-provider or bank processing times. Any associated adjustment to Premium entitlement shall be communicated.

7.2 Cryptocurrency network transactions are not directly reversible. Where a cryptocurrency refund is approved or required, Support shall confirm the lawful method, currency, valuation and any applicable network costs before processing. No deduction or fee shall be imposed where prohibited by law.

8. Billing disputes and governing law

8.1 Alleged duplicate or unauthorised Charges, post-cancellation billing, failure to provide paid access and defects in the Service should be notified to [email protected] with relevant Account and transaction particulars.

8.2 Nothing herein shall prevent a Purchaser from exercising a right against a payment provider, bank or other person, or from seeking relief from a regulator or competent court. This Policy shall be governed by the laws of England and Wales, subject to mandatory consumer protections.
